Birthday Fuel Discount Offer Terms and Conditions

  1. This offer is offered to you by Viva Energy Retail Pty Ltd (ABN 96 662 372 027) Level 16/720 Bourke Street, Docklands VIC 3008, Australia, Ph: +61 3 8823 4444 ("Viva Energy").
  2. The term of this offer remains open until withdrawn by Viva Energy ("Offer Period"). Viva Energy will notify withdrawal or expiry of the Offer Period by providing prior notice on its website, in its App(s) or through an email to its customers.
  3. To be eligible for the offer, individuals must receive an email (“Birthday Email”) from Viva Energy regarding the specific offer described in these Terms and Conditions (“Eligible Claimants”). The offer consists of a 10 cent per litre fuel discount barcode, redeemable in accordance with clause 5 of these Terms and Conditions (“Discount Barcode”). The Discount Barcode will be valid for one use only, for two (2) weeks from the date it is sent via a Birthday Email, and is subject to the Exceptions at clause 4a below and these Terms and Conditions.
  4. This offer is valid with other stackable selected offers offered by Reddy Express at the service station. This may include offer(s) by Coles Supermarket shopper dockets and "spend $20 in store on eligible products at Shell Reddy Express to receive 10 cents per litre fuel discount" – subject to the terms and conditions.
    1. "Exceptions":
      1. This offer cannot be stacked with any other offer offered to you in whole or part by Viva Energy. If you present any other Viva Energy funded fuel discount offer for redemption from any other party e.g. flybuys, Shell Racing Team app (in addition to the birthday fuel discount offer from Viva Energy), only the highest cents per litre fuel discount barcode will be redeemable. If all the Viva Energy funded fuel discount offers have the same cents per litre discount value, then only the first fuel discount offer presented will be redeemed.
      2. This offer does not apply to certain products such as LPG or AdBlue products. Such exclusions may vary from time to time at Viva Energy’s discretion and will be set out on the Terms & Conditions. Fuel discount offer rates are subject to change at Viva Energy’s discretion with prior notice* from time to time.
      3. This offer is not valid for Fleet Card, Shell Card, Motorpass or Motorcharge transactions.
  5. To redeem the Fuel Barcode, Eligible Claimants must, during the two week period after they receive their Birthday Email:
    1. Visit any Shell Reddy Express service station in Australia and fill up their vehicle with a minimum of 2 litres, but no more than 150 litres of any Shell fuel, excluding Diesel, LPG, or AdBlue products; and
    2. Enter the Shell Shell Reddy Express service station, and whilst in-store:
      1. have a smartphone or tablet screen with internet connection, and access to the Discount Barcode in their Birthday Email or have a clear print out of the barcode page from their Birthday Email; and
      2. present the Discount Barcode (on their smartphone or tablet screen, or on their print out of the Discount Barcode) under the customer facing barcode reader when ready to pay for the fuel. Subject to the Exceptions, the discount will be automatically applied to the fuel price, and the Eligible Claimant will then be required to pay the discounted price for the fuel.
  6. Eligible Claimants can only use the Discount Barcode once and the discount will expire at the earlier of the Discount Barcode having been used or two weeks after the date the Birthday Email is sent.
  7. Eligible Claimants agree and acknowledge that they have read these Terms and Conditions and that claiming the discount is deemed to be acceptance of these Terms and Conditions.
  8. Viva Energy reserves the right to refuse processing the Discount Barcode on the basis of irresponsible mobile or other device use on the forecourt or any dangerous or potentially unsafe or illegal behaviour by an Eligible Claimant or failure to comply with the redemption steps.
  9. This offer is not exchangeable or transferable or redeemable for cash.
  10. To the extent permitted by law, if for any reason any aspect of this offer is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of Viva Energy, Viva Energy may in its sole discretion cancel, terminate, modify, or suspend the offer and invalidate any affected Discount Barcodes. Eligible Claimants are solely responsible for ensuring that:
    1. if a tablet or smartphone is used to redeem the offer, the device must be used safely in-store at Shell Reddy Express to correctly redeem the discount;
    2. they are able to read and open the Birthday Email on their email account prior to the expiry of the Discount Barcode; and
    3. they are able to print out the barcode in the Birthday Email and that it can be read by the barcode reader in store.

    Each Eligible Claimant acknowledges that no WI-FI or internet or mobile data access will be provided at the Shell Reddy Express service station and that Viva Energy makes no representation or claim in relation to any of the responsibilities set out in this clause and that the responsibilities are outside of Viva Energy’s control. Each Eligible Claimant is solely responsible for having the relevant equipment and services to access the offer in-store on a device such as smartphone and valid internet service to their device, or via a print out on paper.

  11. Viva Energy reserves the right to disqualify any person from this offer in the event of non-compliance with these Terms and Conditions. In the event that there is a dispute concerning the conduct of the offer, subject to law, the decision of Viva Energy is final and binding on you and no correspondence will be entered into.
  12. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  13. Viva Energy will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this offer or accepting or using any Fuel Barcode, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  14. Each Eligible Claimant agrees and acknowledges that the Eligible Claimant’s sole and exclusive remedy for any problems or dissatisfaction with the offer is to cease participation in the offer, except where otherwise provided by law.
  15. This promotion is to be used by the Eligible Claimant only and not to be distributed or shared by any means. Where the Eligible Claimant distributes or shares their barcode in contravention of this provision, Viva Energy reserves the right to hold the Eligible Claimant responsible and liable for all loss or damage caused or contributed to by this breach.
  16. The governing law and jurisdiction of these Terms and Conditions is Victoria, Australia.
